General terms and conditions of sale (GTC) Babarf

1/ Preamble to the use of the service

Babarf offers several types of products via its website www.babarf.ch and and distributes food portions for dogs to its customers every month.

The purpose of these Terms of Sale is to define the rights and obligations of the parties in the context of the sale of Babarf products. They apply, without restriction or reservation, to all sales offered on the website www.babarf.ch.

Any order placed on the site of www.babarf.ch induce the acceptance of the present Terms of Sale, of which the customer recognizes to have taken knowledge, to have understood them and to have accepted them in perfect knowledge of the facts. The present Terms of Sale are subjected to the Swiss law and the Swiss standards in force.

Babarf reserves the right to modify these Terms of Sale at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations and orders previously accepted and confirmed by the customer.

2/ Legal capacity

The customers of the website declare to be of age and fully capable of contracting.

3/ Geographical area

Babarf products and services are offered only in Switzerland.

4/ Availability of services

The services of the Babarf site are normally accessible by the customer 24 hours a day, 7 days a week and all year long except in case of voluntary or involuntary interruption, whatever the cause.

5/ Prices of services and products on sale on the site

The sales prices of the services and products appearing on the site are indicated in Swiss francs, all taxes included, it being understood that the products ordered are invoiced at the prices in force at the time the order is registered.

The selling prices of the services and products can be modified by Babarf at any time and the modification will then be indicated to the customer before any order.

6/ Characteristic - Conformity of the products

Babarf is likely to modify at any time the assortment of products and services offered for sale on its website, without prejudice to the orders placed by the customer.

Concerning the service of monthly shipment of standard rations, the products included in the rations are not known by the customer prior to his order. The customer has full knowledge and fully accepts the characteristics of this service. Babarf is committed to providing balanced rations over the week, meeting the physiological needs of the dog.

7/ Availability

The offers presented by Babarf are valid as long as they are announced on the site and within the limits of available stocks.

In case of unavailability of one or more products or services after placing the order, the customer will be notified by e-mail. The amount of the order will be recalculated and the customer will be debited with the new amount, less the missing products. If the order is completely unavailable
the customer will be notified by email and will not be charged or will be refunded. In this case Babarf will not be held responsible for any prejudice suffered by the customer, nor will it be held liable for any damages.

8/ Orders

8/1 Order confirmation and acceptance of conditions

When the customer confirms his order by making payment, he is considered to have knowingly accepted these General Conditions of Sale, the prices, volumes, characteristics, quantities and delivery times of the products offered for sale and subject to of his order.

Babarf will confirm this order by sending an email to the customer.

Babarf reserves the right to suspend or cancel any execution of an order and/or delivery, whatever its nature and level of execution, in the event of non-payment or partial payment of any sum owed by the customer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Babarf Website, including in connection with previous orders.

In the event of an error in entering the email address concerned, or non-receipt of the email order confirmation message, Babarf cannot be held liable. In this case, the sale will be considered final, excluding cases of cancellation of the order by Babarf, in particular due to unavailability of the products.

Babarf reserves the right to refuse any order from a customer with whom there is a dispute, even if the customer uses a new account.

8/2 Type of orders and contracts

The Babarf subscription offers delivery of rations every two or four weeks depending on the customer's choice so that the latter benefits from a ration for each day of the month. The subscription is tacitly renewed on a monthly basis and remains active, unless the customer requests its suspension or termination.

It is also possible to place occasional orders. Customers order and receive on-time deliveries. They place orders every time they need rations/meat for their dogs and without automatic order renewal.

Rations will be produced as a priority for Babarf subscriptions. Therefore, the production of an occasional order will be done within 10 working days.

9/ Payments

All orders are payable in Swiss francs.

Payment for purchases is made using a bank payment card or by invoice.

Babarf reserves the right to re-invoice to the customer the additional costs generated by the type of payment chosen by the customer.

The customer guarantees to Babarf that he is fully authorized to use the payment card for the payment of his order and that these means of payment legally give access to sufficient funds to cover all costs resulting from his order on the site www. babarf.ch.

Babarf cannot be held responsible for any fraudulent use of the means of payment used.

Babarf reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the customer or in the event of an incident. of payment.

Delivery of any new order may be suspended in the event of late payment, notwithstanding the provisions herein.

Any payment will be processed by a secure data encryption procedure so that no information transmitted by the customer is intercepted by third parties.

It is up to the customer to save and print their payment certificate if they wish to keep the banking details relating to their transaction.

10/ Deliveries

Babarf offers four methods of receiving rations depending on the customer's wishes and their place of residence:

10/1 Babarf home delivery by refrigerated truck

Home delivery of rations takes place according to a pre-established schedule and at the agreed frequency. Before the scheduled delivery date, the customer is notified by email of a time slot during which the delivery person will deliver the rations. Delivery time slots are given as an indication and may vary depending on unforeseen circumstances or any other factor beyond the control of Babarf. In this case, we will notify you promptly of any potential delays and will do our best to minimize any inconvenience.

10/2 Babarf delivery to a collection point in a refrigerated truck

Delivery to the collection point is made according to a pre-established schedule and at the agreed frequency. Withdrawals are made according to the conditions specific to each withdrawal point. These will be communicated to the customer by email.

10/3 Postal delivery in insulated packages

Postal delivery is made by Swiss Express Lune delivery according to the conditions of the Post Office according to a pre-established schedule and at the agreed frequency. If the package is not received by 9 a.m., the customer is required to notify the Post Office without delay at +41 842 880 088 with the tracking number of their package, and to notify us by email.

10/4 Collections at the production site in Bussigny

Withdrawals are made from our production site at n° 22 chemin Bas-de-Plan, 1030 Bussigny, according to the following schedule: Monday to Thursday from 9 a.m. to 12 p.m. and from 2 p.m. to 5 p.m. and Friday from 9 a.m. to 3 p.m. . They are carried out according to a pre-established schedule and at the agreed frequency. No withdrawals can be made on the site without this having been agreed in advance.

Babarf cannot be held responsible for delivery delays or errors due to an incorrect or incomplete address provided by the customer.

In the event of absence, the customer is required to indicate a place to deposit the rations. It is possible for them to provide us with a suitable freezer, crate or cooler. In this case, and as long as the time is equivalent to “to the door” delivery, the rations will be transferred there by our delivery person. It is also possible to leave our delivery boxes in an agreed location.

If you are not available to receive your order and cannot provide a location to drop it off, please notify our customer service one business day before the expected delivery date. Without this, the customer assumes responsibility for his order once delivered, even if it is left outside the door of the home or of a neighboring third party.

The customer is required to check the status of the order upon receipt and store it, avoiding any break in the cold chain.

In the event of visible damage to the products upon delivery, the customer is required to immediately inform the delivery person and refuse receipt of the damaged products notwithstanding his rights linked to the warranty for defects.

All damages linked to transport or cases of delivery problems or missing products must be reported to customer service on the same day of delivery by e-mail to contact@babarf.ch. Babarf reserves the right to require proof of the defect.

In the event of exceptional loss of the product, the customer has the possibility of contacting our customer service by sending an e-mail to the address contact@babarf.ch in order to obtain a replacement as quickly as possible. Babarf reserves the right to decide whether to offer commercial compensation or refuse a refund depending on the circumstances.

Babarf cannot be held responsible for delays or failures in delivery due to events beyond its control, such as strikes, accidents, natural disasters, crisis situations, etc.

In the event of the occurrence of a case of force majeure, Babarf undertakes to inform the customer as soon as possible and to take all reasonable measures to minimize the impact on delivery.

11/ Modification, suspension and termination of subscriptions

11/1 Changes

Babarf Company reserves the right to change the terms of any subscription at any time, with or without notice, by notifying subscribers electronically or by posting the changes on our website.

Changes to the Subscription Terms will not affect existing Subscriptions unless expressly stated.

In the event of modification of the subscription by the customer, the announcement must be made at least 35 days in advance so that the modifications can be reflected in the next delivery.

11/2 Suspensions

Subscribers may request a temporary suspension of their subscription. This request must be made in writing to contact@babarf.ch and submitted at least ten working days before the next scheduled delivery date. This request can be repeated without limit and no additional fees will be levied.

During the suspension of the subscription, subscription billing is also suspended, subject to compliance with the suspension conditions in force at the time of the request. A request made after the deadline will not result in any change in billing.

11/3 Terminations

Cancellations must be communicated to us in writing at least 35 days before the next delivery date.

Subject to compliance with this 35-day deadline, we will produce and deliver your rations until the requested termination date. After this date, no more goods will be produced and delivered. A partial or total refund of subscription fees already paid will be made in proportion to the days of unproduced rations.

In the event of non-compliance with the mandatory deadline of 35 days before the date of the next delivery, the cancellation of the subscription will only be taken into account for the next subscription period and invoicing will be effective until then.

11/ Retention of ownership

Babarf retains full ownership of the products sold until full payment of the full price, including fees, taxes and mandatory contributions.

12/ Intellectual property

Babarf, its logo and its graphics are registered trademarks. All the elements reproduced on babarf.ch and in particular but not exclusively the texts, comments, works, illustrations, images and brands are protected under intellectual property law. Any total or partial reproduction of the elements accessible on the babarf.ch website is strictly forbidden.

13/ Deactivation of the customer account

Failure by the customer to comply with the obligations under these Terms and Conditions, any incident of payment of the price of an order, actions contrary to the interests of Babarf, the provision of false information when creating an account, may result in the suspension of access to the service of Babarf, or even the termination of his account and subscription depending on the degree of seriousness of the actions in question, without it can be claimed damages or compensation whatsoever to the company Babarf. Babarf reserves the right to refuse any order from a customer with whom there is such a dispute, even if the customer uses a new account.

15/ Confidentiality

The information and data collected by Babarf during any order of the customer are necessary for the management of the orders and the commercial relations.

It may be transmitted to companies that contribute to this relationship such as those responsible for the execution of services and orders for their management, execution, delivery, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to enable Babarf to improve and personalize the services offered and the information sent.

16/ Applicable law and jurisdiction

Any dispute relating to the execution or interpretation of these TOS will be examined and decided according to the law applicable in Geneva (Switzerland).

Transition douce

Les premiers jours il aura ainsi de la volaille, sans os ni abats, puis au fil des semaines seront progressivement ajoutés les os, abats, puis d’autres variétés de viande. Le passage se fait ainsi en douceur vers les repas BARF complets, au rythme de votre loulou.
